COURT OF APPEAL, IBADAN AFFIRMS CONVICTION OF OSINILU DONGO TAYO TO 5-YEAR IMPRISONMENT FOR SELLING MEDICINES IN SHOP NOT REGISTERED AND LICENSED BY PHARMACY COUNCIL OF NIGERIA
The Court of Appeal Ibadan Division on 19th Day of March, 2025 confirmed the conviction and sentence of one OSINILU DONGO TAYO a Pharmacy Technician who was tried and convicted by Federal High Court, Abeokuta on a 5-count charge and sentenced to concurrent term of imprisonment to 5 Years without option of fine and further fine of N10,000 and in default of payment to further term of imprisonment to 6 months. The large consignment of drugs illegally stocked and being sold was also ordered forfeited to the Federal Government. In May 2019, the convict was found PCN enforcement team to have heavily stocked his illegal medicine shop named STAYILDOSH PHARMACY at Ijebu-Ode with all classes of medicines without being registered and licensed by the Pharmacy Council of Nigeria, the regulatory body. When accosted, he claimed that he was a Pharmacy Technician not subject to regulatory control by PCN. He was arraigned tried, convicted and sentenced on all the 5 count-charge. He appealed to Court of Appeal, Ibadan. The Court of Appeal, in its judgement dated 19th March, 2025 found no merit in the appeal and dismissed it and affirmed the conviction and sentences of the Federal High Court, Abeokuta including the consequential orders.
